International interactive round table "Cryptocurrences as a mode of payment: financial and tax issues"

On May 30 2019, at Kutafin Moscow State Law University (MSAL) was held the international interactive round table "Cryptocurrences as a mode of payment: financial and tax issues". The round table was organized by the Department of Financial Law and the Department of Competition Law of the Moscow State Law University O E Kutafin, and the editorial board of the Journal “Law and Digital Economy” MSAL. The round table was organized in conjunction with the Moscow regional branch of the Russian Lawyer’s Association and the strategic partner of the Moscow State Law Academy - the International Union of Lawyers and Economists (France), with the informative support of the publishing house “Iustitsinform” and the publishing house “Prospekt”. The round table was organized within the framework of a study with a grant from the Russian Foundation for Fundamental Scientific Research (RFFI) under the scientific project No. 18-29-16056 “Cryptocurrency as a mode of payment, civil law and tax aspects”. The Pro-Rector for Juridical studies MSAL, Vladimir Sinyukov Doctor in Juridical sciences, Professor, Honored Expert of the Russian Federation addressed the participants and guests of the event with a welcoming address, and noted the importance of this event for the development of Russian science and also for practicing lawyers. During the round table, the legal nature of cryptocurrencies was discussed from the perspective of civil legal regulation, the place of cryptocurrency in the modes of payment systems, the specifics of legal regulation on certain aspects of cryptocurrency activities, State regulation of cryptocurrencies in the context of national security risk, the place of cryptocurrency in the frame of civil rights objects, features of legal regulation of issue, storage, exchange, purchase and sale of cryptocurrency, features of public law problems relate to cryptocurrencies as, well as features of the taxation for the production and use of cryptocurrency. The participants at the round table paid special attention to the discussion of problems of legislative regulation related to cryptocurrency activities, in particular the adoption of the digital right law, as well as possible prospects for adopting a digital code. During the round table, the speakers also reviewed the foreign experience about legal regulation of cryptocurrency activities, in particular, France and Switzerland. In the course of the round table, an active scientific discussion took place between the representatives of the scientific and teaching staff of the University O.E. Kutafin (MSAL) and representatives of scientific schools and leading Russian law schools: Moscow State University M.V. Lomonosov, Ural State Law University, Saratov State Law Academy and other universities, as well as representatives of the business community, successfully introducing digital technology in the cases dealt by law firms. Within the framework of the round table, a new scientific monograph was introduced: “Legal regulation of the digital economy in the modern conditions of high-tech business development in the national and global context: a collective monograph” V.N. Sinyukov, M.A. Egorova; Moscow State University O.E. Kutafin (MSAL) - M .: Prospect, 2019. 240 p. ISBN 978-5-392-22720-4 DOI 10.31085 / 9785392227204-2019-240, representatives from the author’s team, as well as from the editors, spoke at the roundtable. Vladimir Sinyukov, Pro-Rector for Juridical studies MSAL, noted that the authors of the monograph, after choosing the legal regulation of the digital economy and high-tech business as the subject of their study, focused on the peculiarities of state, industry and international regulation of digital legal relations. The monograph presents a range of legal problems arising from the application of digital technologies, and approaches to their solution are proposed. The monograph is mainly a research and can be considered as an attempt to formulate the concept of State law policy in the sphere of digital economy. This study is of theoretical and practical value for the legislator, researcher and practical worker. Maria Egorova, Editor-in-Chief of the journal “Law and Digital Economics”, noted that the monograph addresses issues that will contribute to the development of the digital economy as a whole and the introduction of new legal systems in order to implement state policy on the development of competition in high-tech sectors of the economy, she also outlines the main areas for further improvement in Russian and foreign legislation in the sphere of regulation of the digital economy. Representatives from the group of authors Olga Belyaeva and Alexey Minbaleyev also noted the importance of the monograph and briefly highlighted some of the aspects related to their chosen research topic, included in the sections of the monograph.
